Please read these Terms and Conditions (“Terms”) carefully before accessing or using the services provided by Golden West Humanitarian Foundation (“the Foundation”). 2/ Intellectual Property Rights

The Services and all associated content, including but not limited to text, graphics, logos, images, audiovisual materials, and software, are owned by the Foundation or its licensors and are protected by copyright, trademark, and other intellectual property laws.

 

2.2 Limited License

The Foundation grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, or materials obtained from the Services without the prior written consent of the Foundation.

 

3/ Donations and Contributions

3.1 Donation Terms

When making a donation or contribution through the Services, you agree to provide accurate and complete information and to authorize the payment for the donation amount specified. All donations are final and non-refundable unless otherwise stated.

 

3.2 Tax Deductibility

The Foundation is a 510(c)(3) tax-exempt organization based in California. Donations made to the Foundation may be tax-deductible to the extent allowed by law. It is your responsibility to consult with a tax professional to determine the tax deductibility of your donation.

 

4/ Limitation of Liability

4.1 Disclaimer

The Foundation provides the Services on an “as is” and “as available” basis. While we strive to ensure the accuracy, timeliness, and availability of the Services, we do not warrant that the Services will be error-free, uninterrupted, or free from viruses or other harmful components. You acknowledge and agree that your use of the Services is at your own risk.

 

4.2 Limitation of Liability

To the maximum extent permitted by applicable law, the Foundation and its directors, officers, employees, agents, partners, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.

 

5/ Indemnification

You agree to indemnify and hold harmless the Foundation and its directors, officers, employees, agents, partners, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

 

6/ Modifications to the Services and Terms

The Foundation reserves the right to modify, suspend, or discontinue the Services, in whole or in part, at any time without prior notice. The Foundation also reserves the right to modify or update these Terms at any time by posting the revised Terms on its website. Your continued use of the Services after such modifications will constitute your acceptance of the revised Terms.

 

7/ Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms or the use of the Services shall be exclusively brought in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

 

8/ Entire Agreement

These Terms constitute the entire agreement between you and the Golden West Humanitarian Foundation regarding the use of the Services and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, whether oral or written.
